<p>Under the U. S. Gun Control Act of 1968, guns may not be sold to drug addicts. Most people would agree that this is a good idea, as the mental image of a ‘drug addict’ is almost always negative: shaking, dirty, paranoid, and incapable of rational thought. <em>Nobody </em>wants to arm that person.</p>

<p><strong>Concealed Handgun Permits are refused</strong></p>
<p>The sheriffs of Oregon, however, are classing medicinal cannabis users as drug addicts and refusing to issue concealed handgun permits to them. The sheriff’s office, by state law, should not refuse to grant such a license provided a list of conditions is met. These conditions usually  include U.S. citizenship, completing  a gun safety course, no criminal record, no mental illness or substance abuse problems. Again, these are all reasonable requirements, but the medicinal cannabis patients who fulfill them are still being refused the permit.</p>
<p><strong>Use of prescribed marijuana should not limit a person’s rights</strong></p>
<p>Retired school bus driver Cynthia Willis is one such patient, and along with three co-plaintiffs she is part of a potentially landmark case currently under consideration by the Oregon Supreme Court. Cynthia likes to carry a Walther P-22 automatic pistol, which she says she’s never had to draw, for self-defense. She also uses cannabis to control muscle spasms and pain from her arthritis, but says she never uses it when she plans to carry her gun (or drive). So far she’s won two court cases on the argument that prescribed drug use does not disqualify a person from holding a concealed gun permit, and medicinal cannabis is a prescribed drug like any other.</p>
<p><strong>More at stake than the right to carry a concealed firearm</strong></p>
<p>What is at stake here is not just the right of medicinal cannabis users to carry (concealed) firearms: by Oregon law, if someone doesn’t have a concealed gun permit but does have a gun license, they can simply carry the gun openly, as Cynthia plans to do if she loses her case. Given the tragic events in Alphen aan den Rijn on Saturday as the latest in a long line of horrific shootings by licensed gun owners throughout the world,  it can be argued that gun licenses should be revoked altogether.</p>
<p><strong>How do you abuse your own medicinal cannabis crop?</strong></p>
<p>The underlying issue of concern in Oregon is the classification of medical marijuana patients as ‘drug addicts’, with all the negative connotations of this epithet. Although cannabis seeds have never been illegal in Oregon, and it was the first state to decriminalize possession of small amounts of bud back in 1973, courts recently decided that employers had the right to fire medicinal cannabis users. The sheriffs of this county openly argue that the majority of medicinal card holders are abusing the right to use ganja as a medicine, despite the fact that buying, selling, and dispensaries are still prohibited so patients must grow their own (or have someone grow it for them without profit) in order to do so.</p>
<p><strong>Defending the rights of medical marijuana users</strong></p>
<p>Executive Director of NORML Allen St. Pierre is focused on defending the right of every medicinal marijuana card holder to be treated like any other citizen: “A person who uses medical cannabis should not have to give up their fundamental rights as enumerated by the Constitution,”‘ St. Pierre said.</p>

<p>Historically, hemp has proven to be a versatile and durable substance and therein lies the contradiction. For nearly a century now, Hemp has been overlooked and under-appreciated as a viable alternative to cotton, possibly as a result of its connotative association with marijuana. To clarify, hemp has no psychoactive properties.</p>
<p><strong>PROS: </strong> Hemp fibre is surprisingly useful as a cotton, paper, cellulosic or polymer substitute when it is treated correctly. As a crop, it is low-maintenance and resilient, and requires none of the weeding and heavy use of pesticides usually required in farming.  Hemp is particularly effective as a source for textiles. The fibres drawn from the hemp plant are the strongest and longest in nature. Fabrics, twines, yarns and cords made from hemp are durable and versatile. It can be combed into any gauge or quality of fibre. As a substitute for such diverse substances as cotton, trees, or petroleum, hemp proves to be more environmentally sound than all of its alternatives (requiring about 10% of the water needed to produce cotton) and its versatility and resilience make it economically sound as well.</p>
<p><strong>CONS: </strong>Hemp fibre is characterised by undesirable susceptibility to moisture and rot due to moulds and mildews and the like. It is also characterized by a strong, naturally-occurring odour which makes it unacceptable as a substitute for other odourless fibres. Moreover, hemp fibre in its natural spun state is susceptible to fraying and has a rough hand and feel. A need therefore remains for a hemp product which is suitably strong, soft, flexible, moisture-resistant and rot-resistant and generally suitable for substitution in applications previously focused on the cotton, paper and petroleum-fibre industries.</p>

<p><img class="alignleft size-full wp-image-820" title="herer" src="http://weedforneed.com/wp-content/uploads/2009/09/herer.jpg" alt="herer" width="180" height="366" />News has reached us that the world-renowned author, activist and marijuana anti-prohibitionist Jack Herer suffered a heart attack this weekend.  Emergency crews were called in as he collapsed in his chair after delivering a fiery speech at the Portland Hempstalk Event at Kelly Point Park.  After spending a lengthy amount of time stabilizing Jack at the scene, he was transported to the Emanuel Trauma Center in Portland in critical condition with his son at his side. Soon after that, his family were told that he was the victim of a heart attack, a result of arterial blockage.</p>
<p>Jack is arguably the best-known person in the world on the subject of marijuana; he is an icon of popular culture and his book, “The Emperor Wears No Clothes” is the largest and first account of the real story of marijuana and the techniques used by big money corporations to demonize and criminalize it.</p>
<p>Jack suffered a stroke a few years ago that had left him somewhat challenged in terms of speaking, but those  who heard him speak at the rally on Saturday afternoon noted that his speech was much clearer than it had been in many years.</p>
<p>In an ironic twist, an interview recorded 2 hours before the heart attack with friend  Dr. Phillip Leveque of Salem-News.com, hears Jack explaining how he has been feeling better recently, stating: “I’m healthier than I’ve been in ages… in 10 years!”</p>
<p>Last night the doctors put him in an induced coma and lowered his body temperature with ice. They are keeping him this way for 48 more hours. His heart is doing well for now so they think he will be ok soon. Early reports that he underwent angioplasty are unfounded.</p>
<p>There are no equals to Jack Herer; he is a massive inspiration to us all – we have a huge amount of respect for his dedication to the cause; he is an inspirational figure and a genuine trailblazer.   We wish Jack all the best and we hope that he makes a full and complete recovery.  At this time, our thoughts go out to his son and wonderful wife Jeannie Herer.</p>
<p><strong>UPDATE (17/09/09): </strong>Jack has been taken off of the medications that were keeping him in a state of induced coma. He is not awake yet and the doctors are saying that it may be a few days before …he comes out of the coma. Jack swallowed some fluid into his lung’s during the heart – attack and this caused a minor infection. He is considered stable at this time just in a comatose state.  Good luck Jack – we’re all rooting for you friend!</div>

<p>“This is the approach we have to take because marijuana can bring in some serious revenue….. the pharmaceutical industry needs marijuana as a major ingredient for medication” said Amsale Maryam of the Association of Developmental Agencies in Jamaica, at a Caribbean Regional Civil Society Consultation last month.</p>
<p>Drugs which contain marijuana derivatives are used to treat many diverse medical conditions including glaucoma, bipolar disorder, inflammation of the intestines, nausea and AIDS amongst others – with a reported US$200 million worth of medical-marijuana purchases each year, according to California’s State Board of Equalisation.</p></div>

<blockquote><p><em>Kerlikowske Says Analogy Is Counterproductive<br />
Shift Aligns With Administration Preference for Treatment Over Incarceration</em></p>
<p>The Obama administration’s new drug czar says he wants to banish the idea that the U.S. is fighting “a war on drugs,” a move that would underscore a shift favoring treatment over incarceration in trying to reduce illicit drug use.</p>
<p>In his first interview since being confirmed to head the White House Office of National Drug Control Policy, Gil Kerlikowske said Wednesday the bellicose analogy was a barrier to dealing with the nation’s drug issues.</p>
<p>“<em>Regardless of how you try to explain to people it’s a ‘war on drugs’ or a ‘war on a product,’ people see a war as a war on them,” he said. “We’re not at war with people in this country</em>.”</p></blockquote>

<blockquote><p>Mr. Kerlikowske’s comments are a signal that the Obama administration is set to follow a more moderate — and likely more controversial — stance on the nation’s drug problems. Prior administrations talked about pushing treatment and reducing demand while continuing to focus primarily on a tough criminal-justice approach.</p>
<p>The Obama administration is likely to deal with drugs as a matter of public health rather than criminal justice alone, with treatment’s role growing relative to incarceration, Mr. Kerlikowske said.</p>
<p>Already, the administration has called for an end to the disparity in how crimes involving crack cocaine and powder cocaine are dealt with. Critics of the law say it unfairly targeted African-American communities, where crack is more prevalent.</p>
<p>The administration also said federal authorities would no longer raid medical-marijuana dispensaries in the 13 states where voters have made medical marijuana legal. Agents had previously done so under federal law, which doesn’t provide for any exceptions to its marijuana prohibition.</p>
<p>During the presidential campaign, President Barack Obama also talked about ending the federal ban on funding for needle-exchange programs, which are used to stem the spread of HIV among intravenous-drug users.</p>
<p>The drug czar doesn’t have the power to enforce any of these changes himself, but Mr. Kerlikowske plans to work with Congress and other agencies to alter current policies. He said he hasn’t yet focused on U.S. policy toward fighting drug-related crime in other countries.</p>
<p>Mr. Kerlikowske was most recently the police chief in Seattle, a city known for experimenting with drug programs. In 2003, voters there passed an initiative making the enforcement of simple marijuana violations a low priority. The city has long had a needle-exchange program and hosts Hempfest, which draws tens of thousands of hemp and marijuana advocates.</p>
<p>Seattle currently is considering setting up a project that would divert drug defendants to treatment programs.</p>
<p>Mr. Kerlikowske said he opposed the city’s 2003 initiative on police priorities. His officers, however, say drug enforcement — especially for pot crimes — took a back seat, according to Sgt. Richard O’Neill, president of the Seattle Police Officers Guild. One result was an open-air drug market in the downtown business district, Mr. O’Neill said.</p>
<p>“The average rank-and-file officer is saying, ‘He can’t control two blocks of Seattle, how is he going to control the nation?’ ” Mr. O’Neill said.</p>
<p>Sen. Tom Coburn, the lone senator to vote against Mr. Kerlikowske, was concerned about the permissive attitude toward marijuana enforcement, a spokesman for the conservative Oklahoma Republican said.</p>
<p>Others said they are pleased by the way Seattle police balanced the available options. “<em>I think he believes there is a place for using the criminal sanctions to address the drug-abuse problem, but he’s more open to giving a hard look to solutions that look at the demand side of the equation</em>,” said Alison Holcomb, drug-policy director with the Washington state American Civil Liberties Union.</p>
<p>Mr. Kerlikowske said the issue was one of limited police resources, adding that he doesn’t support efforts to legalize drugs. He also said he supports needle-exchange programs, calling them “<em>part of a complete public-health model for dealing with addiction.</em>“</p>
<p>Mr. Kerlikowske’s career began in St. Petersburg, Fla. He recalled one incident as a Florida undercover officer during the 1970s that spurred his thinking that arrests alone wouldn’t fix matters.</p>
<p>“<em>While we were sitting there, the guy we’re buying from is smoking pot and his toddler comes over and he blows smoke in the toddler’s face,</em>” Mr. Kerlikowske said. “<em>You go home at night, and you think of your own kids and your own family and you realize</em>” the depth of the problem.</p>
<p>Since then, he has run four police departments, as well as the Justice Department’s Office of Community Policing during the Clinton administration.</p>
<p>Ethan Nadelmann of the Drug Policy Alliance, a group that supports legalization of medical marijuana, said he is “<em>cautiously optimistic</em>” about Mr. Kerlikowske. “<em>The analogy we have is this is like turning around an ocean liner,” </em>he said.<em> “What’s important is the damn thing is beginning to turn.</em>“</p>
<p>James Pasco, executive director of the Fraternal Order of Police, the nation’s largest law-enforcement labor organization, said that while he holds Mr. Kerlikowske in high regard, police officers are wary.</p>
<p>“<em>While I don’t necessarily disagree with Gil’s focus on treatment and demand reduction, I don’t want to see it at the expense of law enforcement. People need to understand that when they violate the law there are consequences.</em>“</p>
